I understand and agree that there are inherent risks associated with activities offered at and by Splash Pool Services, Inc and the Homeowners Association at which this swim team is held. Such activities include, but are not limited to swim team participation, private swimming lessons, swim meets (at this facility or being hosted at other pools) and other uses of the facility. Despite such risks, I, my child, my ward, any person under my direct supervision, am/are voluntarily choosing to participate in such activities. As such I assume, on behalf of myself, my child, my ward or any person under my direct supervision, all risk of personal injury, disability, death, or property damage associated with whichever activity I/we am/are registered for at Splash Pool Services, Inc and the Homeowners Association at which this swim team is held. I acknowledge that I, my child, my ward, any person under my direct supervision, have no known medical, physical or emotional health problems that prevent them from participating in such activities.

As a voluntary participant, legal parent, or guardian of participants I release Splash Pool Services, Inc and the Homeowners Association at which this swim team is held, its owners, shareholders, employees, partners, volunteers, manufacturers, and affiliates from any and all future liability, claims, demands, and/or causes of action that may arise from participation in any and all activities. Further, I hereby release, hold harmless and indemnify, including attorney or court fees and costs, and discharge Splash Pool Swim School and Pool Services, Inc., as well as the aforementioned released parties, on behalf of myself and all of my family members (current and future), agents or personal representatives. This release is valid and effective whether the damage, loss, or death is a result of any act, or omission on the part of any Released Parties or from any other cause. This Waiver and Release includes, without limitation, injuries, or accidents, which may occur as a result of use or misuse of the facility in any way, by anyone, use of any equipment that malfunctions or breaks, improper maintenance of the facility, grounds or any equipment, instruction or supervision, or slipping, tripping and/or falling while at the facility or on the premises (including the parking lot and grounds).

In case of medical emergency, I give my permission for my child to receive emergency medical treatment as deemed necessary. I certify that the above-named swimmer(s) is/are covered by medical insurance. I understand that neither the Homeowners Association at which this swim team is held, nor Splash Pool Services, Inc. maintain any form of medical insurance for swim team members. I expressly understand and agree that no officers, agents, volunteers, assistants, or employees of both shall be responsible or made the subject of any claims seeking damage or loss of any sort to myself or other person(s) on whose behalf this form is now signed because of actual or proposed participation on the Swim Team.
